Terms of Use
Last updated:
These terms are the agreement between you and VALICO (“VALICO”, “we”) for the VALICO Road Passport app and the website valicopassport.com. By creating an account or using VALICO you accept them. How we use personal data is explained in the privacy policy.
1. Your account
- You must be at least 16 years old to create an account. Organising rides and proposing or confirming points on the map are for riders aged 18 or older with a complete passport.
- One rider, one account. Keep your sign-in details to yourself: you are responsible for what is done with your account.
- The details on your passport must be true and yours. They are saved once; if something is wrong, write to us.
- Your passport photo must be a clear, front-facing photo of your face, without a helmet. Visas of a passport with an invalid photo may be suspended.
2. Visas and fair play
- A declared visa (I RODE IT) is your word that you rode that pass or road: collect it only for rides you made.
- A verified visa comes from an automatic GPS check-in or from the GPX recording of your own ride. Do not use simulated positions, edited, planned or copied recordings, or anyone else's recording.
- Automatic checks may refuse a check-in or a recording. If you think one got it wrong, write to us and a person will look at it.
- We may take back visas that break these rules, and with them a challenge completion whose code you have not seen yet, and suspend an account that cheats.
3. Ride safely
- VALICO is not a navigation or safety service. Do not use your phone while riding, and follow the highway code and the speed limits.
- Information about passes and roads (names, heights, surface, routes, photos) comes from OpenStreetMap, Wikipedia, Wikimedia Commons, other open data and riders. It can be wrong or out of date: check the road, the weather and any closure yourself before you go. Many passes are closed in winter.
- You ride at your own risk and are responsible for your licence, your insurance and your bike.
4. Rides and meetups
When you organise a ride, a multi-day tour or a meetup, you accept the organiser rules:
- No racing and no stunts: the ride keeps to the highway code and the speed limits.
- Everyone rides at their own risk, with their own licence, insurance and a bike in order.
- You keep the details up to date: change the ride if plans change, cancel it if it does not go ahead.
- The chat links are group links (a WhatsApp group invite or Telegram), never a personal phone number.
- No commercial events or advertising: VALICO and partner events are published by VALICO only.
VALICO publishes rides but does not organise, lead or check them, and is not a party to arrangements between riders. Riders can report a ride and hide its organiser; a ride reported by three riders with a complete passport is hidden until VALICO checks it, and we may remove a ride that breaks these terms.
5. What you add to the map
Points, roads, names, descriptions and photos you send must follow the community guidelines:
- Only real places you have been to.
- Names as on the sign.
- Your own photos: no faces or number plates in focus.
- No ads, phone numbers, links or offensive words.
You declare that what you send is true, that you have the right to send it, and that it breaks no law and no one else's rights.
You keep the rights you have in your photos and texts. You give VALICO a free, non-exclusive, worldwide licence, which VALICO may extend to its service providers, to store, adapt (for example crop or resize), publish and show them in VALICO, that is the app, its map and its website, for as long as they are part of VALICO. A point that has joined the VALICO map stays there after you delete your account, with its photos credited to “VALICO community”, without your name.
6. How we moderate
- Automatic checks refuse contact details, such as e-mail addresses and phone numbers, in names and descriptions, and points that are already on the map.
- A person at VALICO checks every photo before it is shown, and looks at what riders report: every report reaches VALICO by e-mail. We aim to look at reports within 24 hours.
- Three reports from different riders with a complete passport hide a ride, a proposed point or road, or a biker point riders added, until VALICO checks it. Passes on the map and roads VALICO added are never hidden by reports: VALICO looks at their reports and decides.
- You can hide another rider: their rides and their proposals no longer show to you (points already on the VALICO map stay), until you show them again in Settings › Map contributions.
- We may change or remove a contribution, a ride or a photo, stop a rider from contributing, or close an account, when they break these terms or the law. We tell you why, unless the law or the safety of others prevents it, and you can write to us to ask us to look again.
7. Challenges
- Challenges are offered by sponsors and marked “Sponsored by …”. By joining one you accept its sponsor's terms, shown in the app.
- Only verified visas count, within the challenge's dates.
- The reward is the sponsor's discount code for its own products or services, used outside VALICO under the sponsor's terms. VALICO sells nothing, and a code never unlocks anything in VALICO. A code has no cash value and cannot be exchanged for money.
- The sponsor is responsible for its offer. If a visa that counted is taken back before you see your code, the completion may be withdrawn.
- Apple and Google are not sponsors of the challenges and are not involved in them in any way.
8. VALICO's app and content
The app, its design, the passport and visa cards, and the VALICO name and logo belong to VALICO or its licensors. We give you a personal, non-transferable licence to use the app for your own non-commercial use, and you may share images of your own passport and visas. Do not copy or extract the map data or other riders' content, access VALICO by automated means, or take the app apart, except where the law allows it. Map data is © OpenStreetMap contributors (ODbL), with the other sources listed in the app under Settings › Data sources.
9. What is not allowed
Do not use VALICO to break the law, harass, threaten or impersonate anyone, send spam or advertising, collect other riders' data, get around our limits or security, or give false information.
10. Ending
You can stop using VALICO and delete your account at any time in the app (Settings › Delete account). We may suspend or close an account that seriously or repeatedly breaks these terms, and we tell you why. Sections 5, 12 and 14 still apply after an account is closed.
11. The service
VALICO is free. It is new and still changing: features may change, pause or end, and we cannot promise that it will always be available or free of errors. If we ever offer paid features, you will see the price and the terms before you pay.
12. Liability
We provide VALICO with reasonable care. As far as the law allows, we are not liable for what happens on rides or at meetups organised by riders, for the condition of roads and passes, for content added by riders, for sponsors' offers, or for other services that VALICO links to. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, wilful misconduct or gross negligence, or any right you have as a consumer that cannot be limited.
13. App stores
If you downloaded VALICO from Apple's App Store:
- these terms are between you and VALICO, not Apple; Apple is not responsible for the app or its content, and has no obligation to provide maintenance or support for it;
- if the app fails to meet a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price, if any; Apple has no other warranty obligation for the app;
- Apple is not responsible for any claim about the app, such as product liability, failure to meet a legal or regulatory requirement, consumer protection, privacy or intellectual property; within these terms and the law, we are;
- you confirm that you are not in a country under a U.S. Government embargo or designated by it as “terrorist supporting”, and that you are not on any U.S. Government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
If you downloaded VALICO from Google Play, Google Play's terms also apply to the download.
14. Changes and applicable law
We may change these terms when VALICO changes. We will tell you in the app before an important change applies; if you do not agree, you can delete your account. These terms are governed by Italian law. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, you can bring a claim before its courts, and we can bring a claim against you only there.
